Darmok Firearms — Store Policies

By buying/transferring a firearm or any other merchandise through us, you agree to the following policies:

Communications
Email is the authoritative method of communication for all confirmations, authorizations, and changes to orders. Verbal conversations, voicemails, and text messages do not constitute binding agreement or authorization. Please direct all such communications to [email protected].

All Sales Final
All sales at Darmok Firearms are final. We do not offer refunds or returns on any merchandise except as expressly stated in these policies (such as cancellation of unfulfilled special orders or NICS-denied transfers). This includes but is not limited to firearms, ammunition, accessories, parts, gunsmithing services, and any other goods or services. Any warranty claims, defects, or quality issues must be addressed directly with the product manufacturer.

Incoming Shipments
You are responsible for contacting us prior to having a shipment sent for transfer. If you do not receive confirmation from us via email that we are available to receive the shipment, we will not cover the cost to re-ship an item if we are unavailable and it is otherwise returned or held by the carrier. Opting to have something sent without confirmation is done so at your own risk.

Storage of Transferred Firearms
We understand you may not always be able to pick up your new firearm right away. That said, we have limited storage and are regularly receiving new products. Any firearm that is not picked up after two calendar weeks will be charged a $5.00/week storage fee per item.

The storage fee is an all or nothing policy; if you go over the two weeks, an additional $5.00 charge will apply regardless of when during that extra week you pick it up.

Darmok Firearms reserves the right that, once the storage fee meets or exceeds the retail cost of the firearm, to sell said firearm to recover the loss. We are not a warehouse and will not store your products indefinitely. If you don’t have the time to come in and fill out the paperwork in a timely manner, don’t order the firearm.

Denied Transfers
If you are denied a transfer, you may appeal the decision to the ATF/FBI; however, you must pay return shipping costs for us to send your item back to the seller. If you wish, we can also resell the firearm for you on consignment. We will not hold onto your firearm for months while a decision is made.

After one month, the firearm becomes ineligible for the multi-gun discount and will be billed as a separate item (in addition to the $5.00/week storage fee).

Product Listings and Verification
Our e-commerce site uses stock images for item photography. In most cases, these are completely accurate; however, there are some cases where the image may not wholly reflect the item being purchased. It is your responsibility to verify the UPC of the item you are purchasing from us with the manufacturer to confirm you are placing an order for the correct item.

Manufacturer Issues
Any and all issues with the final product resulting from misuse, natural disaster, manufacturing defects, etc. are between you and the manufacturer. Darmok Firearms will not issue a refund concerning any issues between you and manufacturer.

All used and consignment firearm sales are final.

Eligibility
You must be at least 18+ to purchase a long gun in the State of Michigan and 21+ to purchase a handgun or receiver/frame. Darmok Firearms reserves the right to deny a firearm transfer for any reason if there is reason to suspect you are ineligible to receive a firearm. Some examples include: you indicate you are buying the firearm for someone else, you show up with a driver’s license that is expired, you show up with a driver’s license that is clearly a forgery, or you appear to be under the influence of any substance, including marijuana.

Interstate Shipping
All interstate firearm commerce must go through an FFL dealer; we cannot ship directly to your home. If you choose to have a firearm shipped to a dealer in your state, we will contact the dealer for a copy of their license but you are responsible for verifying the dealer is available. Extra shipping costs will be incurred if a package is returned to us because the recipient is unavailable/away.

Subcontracting
We reserve the right to subcontract to other vendors for certain gunsmithing/other projects as required to ensure work is completed with satisfaction. If this should occur, we will advise you and obtain permission to proceed.

Returns
After any firearm purchases are transferred to you, they become ineligible for return. Any follow up would be between you and the manufacturer.

For purchases made through us or an online retailer that need to be returned for any reason, Darmok Firearms will not indemnify any party for any loss incurred in connection with the return. Similarly, Darmok Firearms will pass-on and charge any restocking and shipping fees incurred by needing to return your item to its place of origin, regardless of reason.

Special Orders and Deposits
Special order items must be paid for in full, in advance. A “special order” is any item we order specifically at your request that we do not normally stock.

If you cancel a special order before it ships from the manufacturer or distributor and we are subsequently able to cancel the order with the manufacturer or distributor, we will refund your payment less a 10% administrative fee to cover our time and any costs already incurred.

If you cancel a special order after the item has arrived at our shop or after the manufacturer or distributor has shipped it, the payment converts to store credit. We ordered the item specifically for you and cannot always return it to the distributor. Store credit does not expire and may be applied to any in-stock item or future special order.

If we are unable to fulfill your special order — for example, the manufacturer discontinues the item, the distributor cannot source it, or the backorder exceeds 30 days — you will receive a full refund in your original payment method, unless you explicitly direct us in writing via email to continue waiting for the backorder to be fulfilled. You may withdraw that direction and request a refund at any time while the order remains unfulfilled.

If you are denied on the NICS background check for a special order firearm, we will attempt to return the item to the distributor on your behalf. Any restocking fees, return shipping, or other costs charged by the distributor will be deducted from your refund. If the distributor will not accept the return, we can list the firearm on consignment and remit the net proceeds to you after sale, less our standard consignment fee.

Deposits on In-Stock Items
Deposits on in-stock items hold the item off our sales floor for up to 14 days. If you complete the purchase, the deposit applies to the final price.

If you cancel within 14 days, the deposit converts to store credit usable on any in-stock item or special order.

If you fail to complete the purchase or contact us within 14 days, the item returns to our sales floor and 50% of your deposit is retained as a holding fee, with the remaining 50% issued as store credit.

Store credit issued under this section does not expire and is non-transferable.

Appointments and Pickup
Darmok Firearms operates by appointment only. We do not maintain set walk-in hours. Please contact us in advance via email at [email protected] to schedule a time for pickup, transfer paperwork, or any other in-person business. Storage fees and other time-based provisions in these policies continue to accrue regardless of appointment availability, so please schedule promptly after your firearm arrives.

Payment Methods
We accept cash and all major credit cards. We do not accept personal checks, cashier’s checks, money orders, bank drafts, or similar instruments.

Layaway and Trade-Ins
We do not offer layaway. We do not accept trade-ins; however, we can sell your firearm on consignment on your behalf. Contact us via email for current consignment terms.

Shipping Insurance and Liability
Darmok Firearms will not be held responsible for lost firearms shipments. If your seller chooses to send a firearm without signature confirmation/insurance and the item is lost/damaged during transit, that is strictly between you and the seller.

Likewise, if you choose to use us to mail your firearm out and opt to skip on purchasing insurance, Darmok Firearms is not responsible for your missing package.

Governing Law
These policies, and any dispute arising out of or relating to them or to any transaction conducted through Darmok Firearms, are governed by the laws of the State of Michigan, without regard to its conflict of laws principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Michigan, and you consent to the personal jurisdiction and venue of those courts.

Severability
If any provision of these policies is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed from these policies. The remaining provisions shall continue in full force and effect.
